A photographer shot outside a Malibu home is claiming the plastic pellet was fired by one of Britney Spears‘ minders, while La Spears was at a party inside the house.

Authorities say the origin of the pellet is unclear (”It could’ve been somebody driving by, walking by, we have no idea where it came from”), the victim Brad Diaz is convinced Britney’s bodyguards are to blame. Needless to say, he intends to sue: “I can’t believe it. I was on a public street.”

Diaz went to hospital but doctors said the pellet was embedded too deeply to remove.
