As anticipated, Larry Birkhead has filed court papers to contest the paternity of Anna Nicole Smith’s new daughter Dannilynn with the hope that he can obtain legal custody of the almost month old baby.

During her pregnancy, Anna Nicole refused to name the father of the child but it was presumed to be Larry, who had been Anna Nicole’s off-and-on boyfriend for a couple of years. However, last week, Anna Nicole’s attorney Howard K Stern revealed that he was the father and then married Anna Nicole in a “spiritual ceremony” last Thursday.

In a statement issued through his lawyer, Debra Opri, Larry is asking legal and physical custody of Dannilynn: “[Larry] “a first time father and he is responding to allegations made by attorney Howard K Stern on behalf of Anna Nicole Smith … [Larry] believes beyond any doubt that he is the father.”

Regarding the case, Larry told tv show The Insider: “There’s no doubt in my mind that I want to resolve this and that’s the only way it’s going to happen.”
