Larry Birkhead has demanded Anna Nicole Smith is given a drugs test as part of his paternity and custody case for Anna Nicole’s month-old daughter Dannilynn.

As part of the papers filed on Monday, Larry claimed Anna Nicole was taking methadone, used in the treatment of heroin addiction and coincidentally one of the combination of drugs believed to have killed Anna Nicole’s son Daniel. Larry further claimed that attorney Howard K Stern, who is claiming he is the father of the baby, is aiding Anna Nicole’s habit and encouraged her to stay in the Bahamas to avoid the baby being given a tox-screen.

Larry also suggests that Stern is only claiming to be the father of the child for his own financial gain.

Larry’s lawyer, Debra Opri will appear in court today to request an order forcing Anna Nicole to return to California with Dannilynn immediately so that a paternity test can be carried out.

Regarding the immediacy of the request, Opri said: “The public will be very surprised when they learn of the details of the lifestyle this baby is going to be faced with if she remains in the current situation.”
