Larry BirkheadLarry Birkhead is once again free to take daughter Dannielynn Birkhead to his home in the US after a Bahamian judge dismissed Virgie Arthur’s appeal.

Anna Nicole Smith’s mum Virgie tried to block the earlier ruling allowing Larry to take Dannielynn home until the next custody hearing in June but the judge overseeing the appeal at a Nassau courthouse on Friday called the attempt “weak” and ordered Virgie to pay costs of $3,000 for wasting the court’s time.

After the initial ruling giving him permission, Larry confirmed that a passport for Dannielynn was “in the works” and according to Access Hollywood, a new birth certificate for the eight month old baby girl has been issued - citing Larry as her father and changing her surname from Stern to Birkhead.

Larry has said that after months of being at the centre of a media circus, he is keen to have some quiet time with his daughter - but has been offered a number of deals to stay in the spotlight.

He said this week: “A lot of people are calling. There’s a script for a movie, some TV, an entertainment correspondent for a show, things like that. Maybe I’ll just go off into the sunset with my daughter. I don’t want to live under the microscope like Anna.”

“I want to make a difference for my daughter. Maybe we’ll live a quiet life by the beach, or go back to where I’m from, or find a place to start new. I want to take a few months off to get to know my daughter and for her to get to know me.”

But Larry probably won’t be able disappear entirely even if he wants to - the New York Post reported on Saturday that Larry signed a year long, million dollar deal with NBC Universal shortly after Anna Nicole’s funeral last month.
