Britney SpearsDespite rumours that she would be suicidal if she lost access to her sons, Britney Spears appears not to be too concerned about losing physical custody of the children yesterday.

Los Angeles Superior Court Commissioner Scott Gordon yesterday ruled that Britney’s estranged husband Kevin Federline should have sole physical custody of the boys, Sean and Jayden, until further notice. Judge Gordon refused to discuss his reasoning for the decision but according to Britney’s lawyer, Sorrell Trope, it’s because Britney was unable to produce a Californian driving license and didn’t submit to the required drug and alcohol testing as ordered a fortnight ago.

Trope has now said: “We weren’t able to prove compliance with what the judge ordered. Specifically, the judge ordered that by 10 a.m. [Monday] morning, both parties show valid California driving licenses. I’ve been unable to produce evidence of that.”

“[There also] was a claim by Mr Federline’s attorney that she had not complied with a previous order the court had made before I came on board [as lawyer] – about having a random drug and alcohol test. There’s no evidence that she actually failed a test.”

After Britney heard about losing custody of her sons, she was seen driving to Carl’s Jnr with the children for a quick lunch before handing them over to Kevin’s bodyguard just after noon.

She was then seen driving to her favourite tanning salon, Epitome in Bel Air, before driving on to the Department of Motor Vehicles office in Van Nuys, where she completed paperwork and a written test to apply for a Californian driver license - it came to light last month that she has been driving without a valid license since formally moving to the state several years ago.

Following that, she is said to have hung out with friends at the Peninsula Hotel before going on to dinner at Nobu in Malibu.

But eyewitnesses claim that despite going about the string of activities, the star was on autopilot for most of the day. A source told the Sun: “Britney looked totally shocked and stunned. She kept driving round in circles and a few times she had near-misses.”

“She looked lost, mentally and physically. Her mum has been calling her frantically. Lynne is terrified Britney will do something stupid.”
