shia labeoufThe other driver involved in Shia LaBeouf’s recent car crash has been ordered to appear in court next month.

Shia’s car flipped over twice after Simon Herbert ran a red light and crashed into it in West Hollywood late last month. Simon and Shia’s passenger Isabel Lucas escape with minor injuries but Shia’s hand required surgery and he had to have a month of work from the Transformers sequel.

Police have quickly established that Simon ran the red light but it took until this week for him to be cited over the crash and ordered to appear in court.

Shia was initially arrested for drink-driving at the scene - after field officers said they could smell alcohol on his breath - but a charge has yet to be formally issued. Police are said to be waiting for the return of blood test results before finalising the charge.

However, Transformers director Michael Bay has said he doesn’t think a charge will stick: “[Shia] was not drunk. He was drinking hours and hours before… That [charge is] gonna go away.”
