shia labeoufShia LaBeouf won’t be charged with a DUI offence following his car crash in July, the Los Angeles County District Attorney’s Office announced yesterday.

Shia’s car was flipped onto its roof when it was hit by another car while turning. Field officers at the scene initially claimed Shia was “clearly” under the influence of alcohol as it could be smelled on his breath and he was cited with a misdemeanor DUI before being taken to hospital for surgery on his hand. However, within a few days, police decided that the other driver was at fault after running a red light.

District Attorney Office spokesperson Jane Robison explained yesterday: “After reviewing the case, we’ve declined to file any charges [against Shia] due to insufficient evidence.”

But Shia may still have his driving license suspended by the Department of Motor Vehicles after refusing to cooperate with alcohols assessments. LA County Sheriff’s spokesperson Steve Whitmore explained: “When an individual refuses to take a blood alcohol test, that person’s license is automatically suspended for six to nine months.”

The actor is said to have been driving home from a club with Transformers co-star Isabel Lucas when the incident occurred in the early hours of 27th July. Shia underwent extensive surgery on his hand but earlier this month revealed that it was only to hold it together while he films Transformers 2 and he will have to undergo further surgery to be “back to 100 percent”.
