madonna_01.jpgMadonna’s appeal in her Malawi adoption case has reportedly been successful - despite earlier rumours that it was likely to fail.

Madonna’s request to adopt three year old Mercy James was turned down at the start of April after the judge on the case ruled that the star had not met the country’s residency requirements.

Her legal team took the case to Malawi’s appeal court last month but sources close to the case believed it was unlikely that it would be successful and Madonna was rumoured to be looking at adopting a child from another country in Africa instead.

However, according to the Sun, two of the appeal judges have recommended that the initial ban should be overturned and the third is said to be “in complete unison with them”.

A source told the newspaper that the official verdict will be delivered on Sunday: “The paperwork is being typed up now.

“All recommendations are in favour of the adoption taking place. Mercy should start packing her bags. She’s off to America.”

The source added that Madonna has been told the news by her lawyer in the country Alan Chinula: “She’s ecstatic.

“She made a promise that she wouldn’t give up on Mercy and, believe me, she could move mountains when she’s this determined.

“No stone has been left unturned to prove that ruling was wrong.”

Madonna previously adopted son David from the country in 2006. She also has two older children, eight year old son Rocco from her marriage to Guy Ritchie and twelve year old daughter Lourdes from her relationship with dancer Carlos Leon.
